MANGLES BAY MARINA-BASED TOURIST PRECINCT
1072. Hon LYNN MacLAREN to the parliamentary secretary representing the Minister for Lands:
I refer to the minister’s answers to my question on notice 3881 on 23 June 2011 and to my question without
notice dated 20 October 2011 regarding the proposed Mangles Bay marina-based tourist precinct.
(1) The government asserts that in 2000 the commonwealth indicated “it had no residual interests in the
area or influence over the long-term use of the site”. Please advise —
(a) who specifically indicated this on behalf of the commonwealth;
(b) on what date was this indication given;
(c) was such indication evidenced in writing; and, if so, will the government provide such written
evidence to Parliament; and
(d) if it was not in writing, what is the basis for the government’s assertion?
(2) The government asserts that it has received advice from the commonwealth which “sought to repudiate
the previous commonwealth advice received in 2000”. Please advise —
(a) who specifically provided this later advice on behalf of the commonwealth;
(b) on what date was such advice received by the government;
(c) what exactly was this advice from the commonwealth; and
(d) was the advice in writing; and, if so, will the government provide the advice to Parliament?
(3) What are the specific actions of the commonwealth since 2000 that are said by the State Solicitor’s
Office to “prevent repudiation of the commonwealth’s 2000 opinion”?

I thank the honourable member for some notice of the question. The minister has provided the following answer.
(1)–(3) The matters that are the subject of the member’s questions are still being addressed between the state,
commonwealth, legal and agency offices. I will provide more detailed advice once a resolution is
reached.
